BUBBLYDIVER – GENERAL TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your use of the Bubbly Diver website located at www.bubblydiver.com (the “Site”) and all services, trips, tours, expeditions and courses operated by Bubbly Diver (“we”, “us”, “our”).

By using this Site, booking any service with us, or participating in any of our activities, you
agree to be bound by these Terms, together with our Privacy Policy. If you do not agree, you must not use the Site or our Services.

1. DEFINITIONS

In these Terms:
• “Bubbly Diver”, “we”, “us”, “our” – refers to the company operating tours, courses and expeditions.
• “Site” – means our website and any associated pages, forms or content.
• “Services” – means any service we offer
• “Guest”, “Participant”, “you”, “your” – means any person who uses the
Site, books, pays for, or participates in our Services.
• “Material” – means any text, images, video, audio, code or content on the Site.
• “Force Majeure” – means events beyond our reasonable control (see Force Majeure
clause below).

Headings are for convenience only and do not affect interpretation.

2. AGREEMENT & SCOPE

2.1 By accessing the Site, browsing content, or booking/purchasing any Service, you
acknowledge that:
• You have read and understood these Terms;
• You agree to be bound by them; and
• You are legally capable of entering into binding agreements.

2.2 These Terms apply to:
• Use of the Site
• All bookings (online, via email, WhatsApp, phone, or third-party platforms)
• All participation in any Bubbly Diver activity, domestically or abroad.

2.3 In case of any inconsistency between:
• These General Terms, and
• A more specific written policy for a particular trip or product (e.g., an expedition
brochure, landing page, booking page),
the specific policy for that trip/product will prevail for that service.

3. SITE USE

3.1 You agree to use the Site lawfully and not to:

• Interfere with its operation or servers
• Circumvent security features
• Upload or transmit malicious code
• Scrape, copy or reproduce content without our written consent.

3.2 The Site may contain links to third-party websites. We do not endorse, control or guarantee:
• Their content
• Their services
• Their privacy practices.
You access them at your own risk.

3.3 We do our best to keep information accurate, but we cannot guarantee that all content, dates or pricing on the Site is always up to date. Confirm details directly in your current trip materials or by contacting us.
4. GENERAL SERVICE CONDITIONS
4.1 Right to Refuse Service
We reserve the right to refuse Service to anyone, at any time, for safety, behavioral, capacity or operational reasons.

4.2 Instructor Discretion
Our instructors and guides may refuse or stop delivering part or all of a Service to any participant if, in their judgment, it is necessary for:
• Safety
• Wellbeing
• Behavioral reasons
• Compliance with laws or ethical guidelines.

4.3 Eligibility & Age
Unless specified otherwise, all participants must be at least 18 years old. We may request proof of age at any time.
Participants under 18 years of age may only join a Service if:
• We have given explicit prior approval, and
• A parent or legal guardian has signed all required liability release and medical forms
on their behalf, and
• That parent or legal guardian is physically present during the activity and assumes full
responsibility for the minor at all times.
Bubbly Diver reserves the right to refuse participation to any minor if these conditions are
not met.

4.4 Prerequisites
You are responsible for meeting any prerequisites detailed in the trip/course description (e.g., swimming ability, previous certification level, minimum experience).
Failure to meet prerequisites may result in removal from activities without refund.

5. BOOKING PROCESS

5.1 You may request or confirm a booking via:
• Our website forms
• Email
• WhatsApp
• Third-party booking platforms (e.g., WeTravel)
• Direct communication with Bubbly Diver.

5.2 A booking is not confirmed until you have:
• Received written confirmation from us, and
• Paid the required deposit.

5.3 Payment methods, amounts, and due dates are specified in your:
• Invoice
• Booking email
• Trip/course brochure or landing page.
Payment fees (bank fees, transfer fees, credit card processing, currency conversion) are your responsibility, unless specifically stated (e.g. some activities include credit card and processing fees).

6. BOOKING REQUIREMENTS – MEDICAL, WAIVER & HEALTH

To participate in any Day Tour, Course, Expedition or other Service, you must:

6.1 Medical Form
Complete a medical questionnaire truthfully.
• If you answer
“no” to all risk conditions → you may participate.
• If you answer “yes” to any listed condition → you must provide a medical clearance
from a doctor confirming you are fit to participate.

6.2 Liability Release & Assumption of Risk
Sign our liability release form before joining any activities.
If you refuse, you will not be able to participate, and no refunds will be given.

6.3 Government Health Regulations
You must comply with any current local or international health regulations required for
participation (e.g., vaccinations, travel restrictions). If you cannot join due to failure to meet such requirements, our standard cancellation policies apply.

6.4 Accuracy of Information
Providing false, incomplete or misleading information may result in cancellation of your booking and forfeiture of any payments.
6.5 Diving & Water Activity Requirements
Participants must meet all certification, experience, and fitness requirements specified for their chosen activity. Participants must not participate while under the influence of alcohol, drugs, or any substance that may impair judgment or physical ability. Participants are responsible for informing Bubbly Diver of any medical condition that may affect their ability to safely participate.

7. WILDLIFE POLICY (ALL SERVICES)

7.1 Natural Environments & Wild Animals
Our activities take place in natural habitats. Animals are free, wild and unpredictable.
We design our trips around seasonal patterns and migration, but we never guarantee specific sightings.

7.2 Ethical Encounters
It is not ethical to promise specific wildlife behavior or encounters. We do not bait, chase or
harass animals to create artificial interactions.

7.3 Respect & Safety
By booking with us, you agree to:
• Follow the Wildlife Respect Guidelines explained in your briefing
• Not touch, chase, ride or deliberately block animals
• Respect minimum approach distances when instructed
• Immediately follow guide instructions if animal behavior changes.

7.4 No Refunds for Wildlife Variability
Wildlife presence, behavior and encounter quality vary:
• We cannot guarantee specific species, group sizes or underwater behavior.
• No refunds or discounts are given based on wildlife variability.

7.5 Legal Compliance
We operate in line with laws of the country in which our service takes place, and regulations and local codes of conduct. If authorities impose restrictions or close zones, we will comply—this may affect activities and does not entitle guests to a refund.

8. SPECIFIC CANCELLATION & RISK POLICIES

Below are general policies by service type. Specific trips may have additional terms in their own materials.

8.1.1 Late Arrival Policy
No refunds or credits will be issued for missed departures due to late arrival.
Participants are responsible for planning transportation and arrival times accordingly.

8.1.2 Minimum Participants Policy
Some of our activities require a minimum number of participants to operate safely and
sustainably.
If the minimum number is not reached, Bubbly Diver will:
1. Notify you as early as possible, and
2. Offer one or more of the following options:
• Option 1: Join the activity by covering the cost difference to meet the minimum required
number of participants; or
• Option 2: Move your booking to another date that already has enough participants,
pending availability; or
• Option 3: If neither option works for you, we will cancel the activity and issue a full
refund of the amount paid to Bubbly Diver for that specific service.

Please note:
Bubbly Diver is not responsible for external costs such as flights, accommodation,
transportation, or lost work days in the event of a cancellation due to insufficient participants.
For this reason, we strongly recommend securing travel insurance that covers trip interruptions or cancellations.

8.1.3 Weather, Flights & Missed Days
• If a day or activity is canceled due to weather, strong winds, unsafe sea state or
unforeseen conditions:
◦ No refunds or partial refunds are given for missed or modified days within an Expedition.
• If your flight is delayed or canceled:
◦ You may join the expedition upon arrival.
◦ We do not refund missed days or cover additional transport costs

8.2 LIABILITY RELEASE
To participate in any Trip, all guests must sign a Liability Release & Assumption of
Risk Waiver before joining the activities. Refusal to sign the waiver will result in removal from the Trip without refund.

8.3 TRAVEL DOCUMENTS & INSURANCE
8.3.1 Passports & Entry Requirements
You are responsible for ensuring you meet all passport, visa, entry, and transit requirements for the destination country.

8.3.2 Travel Insurance
Comprehensive travel insurance is strongly recommended, covering:
• Medical expenses
• Emergency evacuation
• Trip cancellation/interruption
• Lost luggage
Bubbly Diver is not responsible for costs incurred due to lack of adequate insurance.

8.4 TRIP CHANGES AND CANCELLATION

8.4.1 ITINERARY CHANGES
Bubbly Diver may modify activities, schedules, timing, locations, operators, or the order of
events due to:
• Weather
• Safety considerations
• Mechanical issues
• Local regulations
• Operational or logistical needs
• Circumstances beyond our control
Such changes do not entitle guests to refunds.

8.4.2 CANCELLATION BY PARTICIPANT
All cancellations must be submitted in writing by email to hello@bubblydiver.com
• Deposits are always non-refundable.
• Final payments become non-refundable once paid
In some cases, and at Bubbly Diver’s sole discretion, you may transfer your spot to another
suitable participant who meets the Trip requirements.

8.4.3 CANCELLATION BY Bubbly Diver
8.4.3a Insufficient Participants
If a Trip is postponed due to insufficient bookings, you may choose to:
(i) receive a refund of all payments made to Bubbly Diver, or
(ii) transfer your payment to another date within a 12-month window, pending availability.

8.4.3b Circumstances Outside Our Control
Bubbly Diver may modify, postpone, or cancel a Trip due to factors outside our control,
including but not limited to:
• Operator failure or liquidation
• Regulatory changes
• Border closures
• Changes in local laws or permits
• Extreme weather
• Political instability
• Safety concerns
Refunds or credits will follow Section 8.5 (Force Majeure).
Bubbly Diver is not responsible for currency fluctuations, and refunds (if applicable) will
be processed for the same amount originally received, regardless of exchange rate changes.

8.5 FORCE MAJEURE
8.5.1 Definition
Force Majeure refers to any event beyond the reasonable control of Bubbly Diver, including
but not limited to: natural disasters (hurricanes, tropical storms, flooding, earthquakes, volcanic activity), extreme weather or sea conditions, war, terrorism, strikes, civil unrest, pandemics/epidemics, government restrictions, border closures, or any circumstance that makes the Trip unsafe, unlawful, or impossible to operate.

8.5.2 No Refunds or Rescheduling
If a Trip is canceled, interrupted, or modified due to Force Majeure, Bubbly Diver is not
obligated to issue refunds, credits, or reschedule the Trip.
All payments already made will be non-refundable, consistent with industry standards for
international expeditions where suppliers, operators, and logistics cannot offer refunds under
Force Majeure conditions.

8.5.3 Strong Recommendation to Purchase Travel Insurance
Because Force Majeure events are unpredictable, all participants are strongly advised to
purchase comprehensive travel insurance that covers: Trip cancellation, Trip interruption,
weather-related disruptions, natural disasters, medical emergencies, evacuation, lost luggage.
If you choose not to purchase appropriate travel insurance, you assume full financial
responsibility for any losses resulting from a Force Majeure event.

8.5.4 No Responsibility for External Costs
Bubbly Diver is not responsible for any expenses incurred in preparation for the Trip or due
to Force Majeure, including but not limited to: flights, hotels, visa fees, gear purchases, loss of work/income, additional travel expenses, insurance claims or disputes.

8.6 CODE OF CONDUCT
Guests must:
• Follow all instructions from guides and crew
• Respect wildlife (no touching, chasing, or harassment)
• Act safely toward themselves and others
• Refrain from illegal drugs and excessive alcohol
• Behave respectfully to staff, guests, and local communities
Bubbly Diver reserves the right to remove any participant whose behavior is unsafe or
disruptive, without refund.

8.7 LIMITATION OF LIABILITY
To the maximum extent permitted by law, Bubbly Diver is not liable for:
• Injury, illness, death
• Loss or damage to personal property
• Delays or cancellations
• Acts or omissions of third-party operators
• Weather, wildlife, or environmental conditions
Our total liability shall never exceed the amount paid to Bubbly Diver for the Trip.

9. ASSUMPTION OF RISK & SAFETY

By participating in any Service offered by Bubbly Diver, you acknowledge and agree to the
Following:

9.1 Inherent Risks
Ocean and wildlife activities involve natural and unavoidable risks, including but not limited to:
• Injury, illness, drowning, or accidents
• Strong currents, waves, or changing weather
• Boat-related risks
• Equipment malfunction or failure
• Encounters with wildlife and unpredictable animal behavior
• Environmental hazards such as sharp coral, jellyfish, or debris
You understand these risks and voluntarily choose to participate.

9.2 Safety Instructions
You agree to:
• Follow all safety briefings, rules, and guidance from instructors, captains, and guides
• Use appropriate equipment and behave respectfully toward the ocean environment
• Prioritize your own physical limits and notify us of any discomfort or concerns
Failure to follow instructions may increase risk significantly

9.3 Equipment Use & Damage
If Bubbly Diver provides or rents any equipment (including but not limited to masks,
snorkels, fins, wetsuits, weight belts, lifejackets, flotation devices, cameras, GoPros, lights, or any other gear), you agree to:
• Use it responsibly and for its intended purpose
• Return it in the same condition in which it was received
• Not modify, alter, or misuse the equipment
You are fully responsible for any loss, theft, damage, or breakage that occurs while the
equipment is in your possession.
Replacement or repair value will be determined at our discretion, based on the brand, model,
and current market price + shipping.
If equipment is damaged or lost, you agree to pay the full replacement cost + shipping on
the same day the damage occurs.
Bubbly Diver may refuse continued participation until repair or replacement costs are
settled.

10. INTELLECTUAL PROPERTY

All content on the Site and in our materials (text, logos, photos, videos, layout, design) is owned by or licensed to Bubbly Diver. You may:
• View content for personal, non-commercial use.
You may not:
• Copy, redistribute, modify, or use content for commercial purposes without our written
permission.

11. PHOTOS, VIDEO & USER CONTENT

11.1 Media Use
We may capture photos and video during our Services.
Unless you explicitly opt out in writing before the trip, you grant us permission to use images
or video of you for promotional and educational purposes (website, social media, presentations). We commit to using them respectfully.

11.2 User Comments & Feedback
If you send us feedback, testimonials, suggestions or comments (by email, DM or otherwise), you grant us a non-exclusive right to use, reproduce and adapt that content for marketing and communication, unless you clearly request otherwise.

12. INDEMNITY

You agree to indemnify and hold harmless Bubbly Diver, its owners, staff, guides and
partners from any claims, losses, damages, costs or liabilities arising out of:
• Your breach of these Terms
• Your behavior during activities
• Your use of the Site or Services.

13. CHANGES TO TERMS

We may update these Terms from time to time.
Changes take effect once published on the Site. Continued use of the Site or Services after
changes means you accept the updated Terms.

14. GOVERNING LAW & JURISDICTION

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of laws principles. However, all tours, activities, and services provided in a destination country are subject to the mandatory laws, regulations, and governmental requirements of that country. Nothing in these Terms shall be interpreted as excluding or limiting the application of any mandatory local laws or legal obligations that apply to services provided within the destination country.

By:

• Booking any Service, or
• Participating in any activity with Bubbly Diver, you acknowledge that you have read, understood and agree to these Terms & Conditions.
